Terms of Use — circle4us

Welcome to circle4us. These Terms of Use ("Terms") govern your access to and use of the circle4us mobile application (the "App") provided by circle4us ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you are using the App on behalf of a minor or are a parent/guardian, you represent that you have the legal authority to bind that minor to these Terms.

Please read these Terms carefully. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

• By downloading, installing, accessing, or using the App, you accept and agree to these Terms and any policies referenced herein.
• If you do not agree to these Terms, you must immediately stop using the App and delete it from your device.
• These Terms constitute the entire agreement between you and circle4us with respect to the App, superseding any prior agreements.

2. Description of Service

• circle4us is a creative drawing game application for iOS that lets users draw shapes (circles, squares, triangles, and more), receive accuracy scoring and feedback, and view rankings and visual representations such as heatmaps.
• The App is designed to engage both casual doodlers and young artists by providing an interactive drawing canvas, real-time feedback, and visual indicators of performance.
• The App is provided as-is and may be updated, modified, or discontinued at our discretion.

3. User Accounts & Registration

• Account Creation: The App may offer optional account or profile features (such as a display name or local profile). When account features are provided, you must choose a display name that does not infringe on others’ rights or violate the Acceptable Use provisions below.
• Age and Parental Consent: The App is designed for use by children. No personal data is collected by the App. If any account or profile feature is enabled that would require storage or transmission of user-provided personal information in the future, parental or guardian consent will be required for users under applicable age thresholds. Parents/guardians should supervise their children’s use.
• Account Security: You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. Notify us promptly at circle4us@forvibe.app of any unauthorized use or security breach.

4. User Obligations & Acceptable Use

• General Conduct: You agree to use the App lawfully and responsibly. You will not:
  • Use the App to post or transmit content that is illegal, abusive, obscene, defamatory, threatening, harassing, or otherwise objectionable;
  • Upload, post, transmit, or store content that infringes intellectual property or proprietary rights of others;
  • Interfere with or disrupt the App, servers, or networks, or attempt to gain unauthorized access to any part of the App;
  • Use automation, bots, or other means to create fake scores, manipulate rankings, or otherwise cheat.
• User Content: The App may allow creation or submission of drawings and in-app content (“User Content”). By submitting User Content:
  • You warrant you have the legal right to submit it and that it does not violate these Terms;
  • You grant circle4us a non-exclusive, royalty-free, worldwide, sublicensable, transferable license to use, reproduce, distribute, display, and perform the User Content in connection with the App and related services (this license is only for operating, promoting, and improving the App and does not obligate us to make any User Content public).
• Safety: Because the App is intended for children, do not include personally identifiable information (names, addresses, phone numbers, email addresses, school names, or other sensitive data) in drawings or display names.

5. Intellectual Property Rights

• Ownership: The App, including its code, graphics, user interface, audio, text, and design, is owned by circle4us or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• Limited License: Subject to your compliance with these Terms, circle4us grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your compatible iOS device for personal, non-commercial use.
• Restrictions: You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or create derivative works of the App except as expressly permitted by law or with our prior written consent.

6. Disclaimers & Limitation of Liability

• No Warranties: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, circle4us DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• No Guarantee: circle4us DOES NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
• Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL circle4us, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID US IN THE PRIOR TWELVE (12) MONTHS, WHICHEVER IS GREATER.
• Some jurisdictions do not allow the exclusion or limitation of liability for certain damages; in such jurisdictions, our liability is limited to the fullest extent permitted by law.

7. Subscriptions & Payments

• Current Status: As of the Effective Date, the App does not require payments and does not include advertising or third-party services. We currently offer the App free of charge.
• Future Paid Features: We may introduce in-app purchases, subscriptions, or paid features in the future. If and when paid features are offered:
  • Purchases will be processed through the Apple App Store and are subject to Apple’s terms and billing policies.
  • All sales are final except as required by applicable law or the App Store’s refund policies. Refunds (if any) will be handled in accordance with the App Store procedures.
  • Recurring subscriptions will auto-renew unless canceled by you through the App Store account settings prior to the renewal date.
• No Billing Information Collected: The App does not collect payment information directly. Any payment transactions will be handled by the App Store or designated payment processors.

8. Termination

• Termination by You: You may stop using the App at any time and uninstall it from your device.
• Termination by circle4us: We may suspend or terminate your access to the App, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
• Effect of Termination: Upon termination, your right to use the App ends. Sections that by their nature should survive termination (such as Intellectual Property Rights, Disclaimers & Limitation of Liability, Governing Law) will continue in effect.

9. Governing Law

• These Terms and any disputes arising out of or relating to them or the App are governed by the laws of the State of California, United States, without regard to conflict of laws principles.
• For any dispute not subject to mandatory arbitration, you and circle4us consent to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California.

10. Changes to Terms

• We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms within the App and updating the "Last Updated" date above.
• Continued use of the App after the Effective Date of updated Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App and delete it.

Additional Notes for Parents and Guardians

• The App is designed for children and does not collect personal data. If you have any concerns about your child’s use of the App, or if you believe we have inadvertently collected personal information about your child, please contact us immediately at circle4us@forvibe.app.
• If parental consent is required in your jurisdiction for certain features, we will require appropriate verification and consent before enabling those features.
